The reason for the privacy regulator's action was media coverage about the Risk Analysis Model (RAM). Last year, it came out that until 2021, the tax authorities collected personal data on a large scale from taxpayers to supervise and combat fraud. According to the AP, this probably happened without a basis. The data was stored in RAM, and the supervisor is already investigating this.

Van Rij: “The AP is establishing a supervisory arrangement to monitor and control the actions of the tax authorities, but also to provide guidance in sustainably improving the protection of personal data. In doing so, the AP will focus on various themes, such as the use of risk models, the culture within the tax authorities with regard to dealing with personal data, the exchange of data and the state of the privacy organization. In April 2024, the AP started conducting inventory interviews with employees of the tax authorities to get an idea of the current situation at the tax authorities. Based on these discussions, the AP decides which actions it deems necessary. The tax authorities are informed about this by the AP. For example, the AP can make agreements with the tax authorities about carrying out interim audits on new processes and systems. In addition, the supervisory arrangement is aimed at strengthening the privacy organization so that the tax authorities can achieve a structural improvement in terms of protecting personal data.” In order to be able to carry out the activities that are necessary to carry out and be effective, the AP expects the supervisory arrangement to last 5 years.
