After all, you must then make it plausible that you have submitted the appeal in the mailbox and that is not easy, according to a ruling by the Department today. 👉 In this case (ABRVS April 16, 2025, ECLI:NL:RVS: 2025:1707), the Department found a manually completed shipping administration and a statement from the person who issued the mail were not sufficient to assume that the appeal was delivered in the mail. 📹 My advice: film the moment you put the letter in the mailbox. It may feel a bit excessive and people look at you strangely, but it can cost you dearly not to. ✨ Good news: from 1 January 2026, appeals can always be filed electronically, thanks to the Electronic Administrative Traffic Modernization Act (article 2:13 Awb (new)). 📌 Until then: ✔️ Keep filming ✔️ Send by registered mail or ✔️ Submit electronically (and fix absenteeism if the governing body refuses)
