Ministry of Finance files report on suspected crimes

The Ministry of Finance has filed a report with the Public Prosecution Service regarding the suspicion of two possible crimes related to the childcare benefits fraud investigations: the official misconduct of extortion by a public official and the crime of professional discrimination. The Public Prosecution Service will investigate the report.

The report concerns activities of the Tax Authorities, more specifically the Fraud Management Team, the Facilitator Approach Combiteam, and the Benefits Directorate. This covers the period from 2013 to 2017.

The reason for the report is the advice of an independent expert, Mr. Biemond. Since March 20, following questions from the House of Representatives and at the request of the Ministry of Finance, he has been studying the public documents related to the childcare benefits fraud investigations.

Biemond not only looked at official misconduct but also at other potentially relevant crimes. In his advice, Biemond emphasizes that his advice says nothing about the culpability of the behavior of specific individuals. In the interest of the investigation, employees, and the organization, appropriate measures will be taken where necessary.

Biemond bases the suspicion of professional discrimination on queries made in the Tax Authorities' systems based on ethnic origin. Extortion by a public official is the deliberate and wrongful demand for payment by an official.

In his advice, Biemond states that he used 'a reasonable suspicion of a specific crime' as a criterion to assess whether there is an obligation to file a report with the Public Prosecution Service. He emphasizes that this should not be inferred to mean that these possible (official) crimes have actually been committed.

The State Secretaries write: ‘We are well aware that this has a significant impact on both the parents involved and all employees of the Tax Authorities and Benefits. In discussions with parents, both individually and in broader sessions, what the report means for them will be discussed. Extensive attention will also be paid to this with the employees of the Tax Authorities and Benefits. In the interest of the investigation, employees, and the organization, appropriate measures will be taken where necessary.’
