Step by step, parents who already participated in the Pilot in (Equal) worthy Recovery can restart. That's why we'd like to take you back to a clarified version of the Frequently Asked Questions.

For all Narrators in the various phases of their (Equal) worthy Recovery, we will gradually organize several Digital Restart Sessions in the coming period. This way, everyone can take steps in the recovery process from a connection with each other, with trust and with the right information. Learn more about what this means for you below.

Are you already working on your (Equal) worthy Recovery Process? (step-by-step Restart)

Step-by-step Restart: If you don't know what phase of your (Equal) worthy Recovery process you're in, you can email to vragen@gelijkwaardigherstel.nl or ask your Coordinator for this. Together with you, we can then see what phase you are in.

Phase 4) Are you in the Finalisation phase and have you already had a Feedback Interview? Everyone in this phase has now been contacted and the first Narrators from this phase have been able to sign their Collective Settlement Agreement with the government.

Phase 3b) Are you in the Damage Analysis phase and have you already participated in the DIS 'Damage Analysis and Completion'? The past few months have caused a lot of unrest. Because we would like to take you as closely as possible into the changes in the Damage Analysis phase compared to the Pilot, we invite you to a Digital Restart Session “Damage Analysis and Completion”. This way, you know exactly what to expect and you can take next steps based on your own direction. These sessions are specifically intended for Narrators in phase 3b and will take place in the week of August 20. From your Coordinator, you will receive an email invitation with a registration link for one of these sessions. Meanwhile, the Damage Analysis team will continue with the preliminary work for your calculation to prepare everything for the Internal Quality Check. This includes collecting supporting documents to gain insight into your timeline, to make your Fact Report as complete as possible. From August 26, the Damage Analysis team can contact you to schedule your Concept Analysis interview. This does not mean that your Concept Analysis Interview can take place immediately on August 26. The Damage Analyst will call you to schedule your Concept Analysis Interview.

In the Concept Analysis conversation, the Damage Analyst takes you through all the impactful events that have been identified based on your Fact Report. No amounts will be shared during this conversation yet. As a Narrator, if applicable, you can share any additional information in consultation with the Damage Analyst. In this Concept Analysis conversation, your Claims Analyst will also take you through the next steps, including the Feedback Interview.

Phase 3a) Are you in the Damage Analysis phase and have you not participated in the DIS 'Damage Analysis and Completion' yet? At the moment, we cannot immediately invite you to a DIS “Damage Analysis and Completion”, so the Damage Analysis team cannot immediately start carefully reading your Fact Report. This has to do with the capacity we currently have and the gradual expansion of that capacity. In the coming period, we will recruit and train new Damage Analysts so that we can calculate more and more facts and, in addition to emotional recovery, we can also offer you financial recovery. As soon as possible, we will invite you to a DIS “Damage Analysis and Completion” via email in groups. We do this based on the date of submitting your Fact Report. In this phase of your (Equal) worthy Recovery, it is good to check whether your Fact Report is complete and that all your feelings are well expressed. Because only on the basis of a complete Fact Report can the Damage Analysis team calculate what you are entitled to. You always have the choice to go back to Phase 2 (Drafting a Fact Report) in the SGH portal in order to be able to write again or add to your Fact Report. If this is what you want, your Coordinator can help you with this. You are and remain very welcome in your Coordinator's Personal Walk-In Office Hours. The times of these Personal Walk-In Office Hours can be found in your Coordinator's signature and on the contact page in your SGH portal.

Phase 2) Are you preparing your Fact Report? We think it's important that you take time for your emotional recovery in this phase. So keep working with your Listening Writer at your own pace on your Fact Story. It is important that your Fact Report is complete and that all impactful events and feelings are expressed. This will soon help enormously in making a careful calculation. It is good to know that currently, when you submit your Fact Report for calculation, you cannot immediately participate in a DIS “Damage Analysis and Completion” and the Damage Analysis team cannot immediately start reading your Fact Report carefully. This has to do with the capacity we currently have and the gradual expansion of that capacity. In the coming period, we will recruit and train new Damage Analysts so that we can calculate more and more facts and, in addition to emotional recovery, we can also offer you financial recovery. You are and remain very welcome in your Coordinator's Personal Walk-In Office Hours. The times of these Personal Walk-In Office Hours can be found in your Coordinator's signature and on the contact page in your SGH portal.

Phase 1c) Do you have a Coordinator but are you waiting for a Listening Writer? We would like to invite you to a Digital Restart Meeting this week. The past few months have caused a lot of unrest. That is why we would like to take you back in the route of (Equal) worthy Recovery and the changes compared to the Pilot. So we hope that you can then get started with your Listening Writer with the right information and feeling good. Parents say that the (Equal) Worthy Recovery route can be emotionally difficult, so feel free to take the time if you need it. This Digital Kick-Off Meeting is specifically intended for Narrators in phase 1c and will take place at:

  • Wednesday, August 14, from 7 p.m. to 8 p.m.
  • Friday, August 16, from 4:00pm — 5:00pm.

Through your Coordinator, you will receive an invitation with a unique link to these sessions. Starting Monday, August 19, your Coordinator will match you with a volunteer Listening Writer so that you can begin your emotional recovery.

As soon as we know when to organize these Restart meetings, you will receive an invitation from us by email.

By attending these meetings, everyone can start the recovery process from connection with each other, with trust and with the right information. Parents say that the (Equal) Worthy Recovery route can be emotionally difficult, so feel free to take the time if you need it. As soon as we know when to organize these Restart meetings, you will receive an invitation from us by email.

Are you already working on your (Equal) worthy Recovery process and haven't had a Feedback Call yet? This has changed compared to the Pilot:

All Narrators who already participated in (Equal) worthy Recovery (phases 0 to 4) in the Pilot can continue the route regardless of the amount of their Integral Assessment. You can continue in the phase you are in and gradually resume your steps of healing and recovery.

Recovery model validated

The SGH recovery model as we used it in the Pilot has remained intact and thus remains in line with Dutch personal injury law.

Refining claims in the Recovery Model

On a few impactful events from a Fact Report, the Recovery Model has been more refined. For example, a standard amount has been set for the claim item “income damage” that is more in line with personal injury law. Here, average age and education are included with more precision in the Recovery Model and thus in the damage analysis. Even in the case of “loss of assets”, a standard amount has now been reached with more precision.

Integral Assessment (IB) Start Date

The start date of the IB forms the starting point for the damage analysis, which includes the damage suffered after this start date in the damage analysis. If there is an incorrect start date in your IB, the appeal process against the Integral Assessment must be completed first.

Concept Analysis Conversation

During the Concept Analysis Interview, the Damage Analyst takes you through all the impactful events identified based on your Fact Report. No amounts will be shared during this conversation yet. As a Narrator, if applicable, you can share any additional information in consultation with the Damage Analyst.

The Concept Analysis Discussion was introduced as a result of the external Quality Check (see below). Before we share the analysis and supporting documents with the Ministry, or later the external party, we think it is important that you, as Narrator, have insight into the analysis made by the Damage Analysis Team.

Quality check It is crucial for us that parents are treated fairly throughout the process and that the damage analysis is careful so that everyone gets what they are entitled to. The quality check ensures that your calculation has been made on the basis of Dutch personal injury law. The quality check consists of two parts:

  • Internal quality check

Before the Concept Analysis Interview takes place, we internally check the accuracy of the damage analysis and the progress of the damage calculation process.

  • External quality check

After the Concept Analysis Interview has taken place, with your permission, the ministry, and soon an external party, will review the damage analysis prior to your Feedback Interview. This way, we can be sure that your calculation can no longer change. After approval from the ministry/external party, the Damage Analyst will make an appointment with you for the Feedback Interview. During this Feedback Interview, the final calculation will be discussed, including amounts. The C-VSO is an equivalent agreement with final discharge between the liable and injured party. Both parties, including the liable party, must always support the agreement. The ministry therefore wants to choose the external party itself. Are you not yet working on your (Equal) worthy Recovery? (step-by-step Opening)

Step-by-step Opening: Currently, it is not possible to sign up for (Equal) Worthy Recovery. However, in the course of September, we will start organizing Information Sessions, where you can orientate yourself on the route of (Equal) Worthy Recovery. This way, with the right information, you can make an informed choice for an additional damage route. Unfortunately, we do have to prioritize this.

  • Partly at the request of the House of Representatives, focus was placed by prioritizing the SGH route. It has been agreed that in this phase, the route will primarily (not exclusively) be offered to parents who, according to the Integral Assessment, have more damage than the 30,000 euros they have already received from the Catshuis scheme.
  • Of course, we are well aware that the amount of the Integral Assessment says nothing about the impact of the unlawful recoveries. But the House of Representatives and the Cabinet have made this a condition. The cabinet and SGH have agreed to consult soon about a solution for parents who, according to the Integral Assessment, have less damage than the 30,000 euros they have already received from the Catshuis scheme, but may nevertheless have suffered damage.
  • It has also been agreed that the cabinet will consult with SGH before the end of 2024 about the possibility of opening the SGH route to former partners, people with an OGS decision and parents who already follow or have followed another damage route.

This prioritization is a disappointing message for many. However, SGH remains fully committed to making the route open to everyone. We will not let go and will always keep everyone informed about the progress of these conversations. As an example: at the time of the Pilot, for example, we also ensured that parents who object or appeal against their IB were still able to participate in (Equal) worthy Recovery.

Can I sign up to SGH later if my Integral Assessment is below 30,000 euros?

It has been agreed that in this phase, the route will primarily (not exclusively) be offered to parents who, according to the Integral Assessment, have more damage than the 30,000 euros they have already received from the Catshuis scheme.

Of course, we are well aware that the amount of the Integral Assessment says nothing about the impact of the unlawful recoveries. But the House of Representatives and the Cabinet have made this a condition. The cabinet and SGH have agreed to consult soon about a solution for parents who, according to the Integral Assessment, have less damage than the 30,000 euros they have already received from the Catshuis scheme, but may nevertheless have suffered additional damage.

What is the perspective for parents with an OGS decision, former partners and people from a different damage route?

You can't begin your (Equal) worthy Recovery process yet. Among other things, it has been agreed that the cabinet will consult with SGH before the end of 2024 about the possibility of opening the SGH route to former partners, people with an OGS decision and parents who already follow or have followed another damage route.

Answers to Frequently Asked Questions

  • What does “the start date” of your Integral Assessment mean? The start date of your Integral Assessment refers to the date on which the first wrongful recovery occurred, according to the tax authorities (“the 1st wrongful recovery, reduction or termination of the childcare allowance as described in the IB”). This date is often found in the explanation in your IB when “calculating compensation for immaterial damage”. Can you proceed to the Damage Analysis Phase if you are still objecting to your Integral Assessment? Yes, you can proceed to the Damage Analysis Phase if you are still objecting to your Integral Assessment. The damage analysis is made based on the information from your Integral Assessment. The start date of your IB is used as the start date of impactful events. When you're in Objection, you can choose to pause your (Equal) worthy Recovery. You can only do this before the Feedback Call takes place. Can you go through the SGH route again at a later time after your objection has been settled? If you stop the SGH route, you will not be able to participate in (Equal) worthy Recovery again. However, you can pause your recovery. You can only do this before the Feedback Call takes place. Can the Feedback Interviews take place before an external party has been appointed? Yes, the Feedback Conversations can take place before an external party has been appointed. Indeed, it is not desirable to wait until an external party has been appointed. In the meantime, the ministry will carry out this external quality check. If you do not want the ministry to carry out the quality check, you can choose to wait until the external party has been appointed (own direction). Unfortunately, we do not yet know when the external party will be appointed. How does the independence of the (Equal) worthy Recovery Foundation relate to the fact that the external party is elected by the ministry? The quality check by an external party is part of the agreements with the ministry. The ministry signs the C-VSO and, as a contracting party, therefore wants to do a Quality Check. This has been identified as important by the House of Representatives and the Senate. The Foundation remains independent:
    • The Fact Story is not shared with the ministry/external party.
    • Before information is shared with the ministry/external party, we ask for your permission.
    What does the ministry/external party check? The ministry, and soon the external party, will carry out a quality check on the damage analysis made by the SGH Damage Analysis Team. To do this, the ministry/external party receives your Integral Assessment, the damage analysis made and the supporting documents. The ministry/external party therefore does not receive your Fact Report.
