During the Parliamentary Fraud Policy and Services Survey, last September and October, we were able to watch interrogations for 5 weeks. For me, as a victim of fraud policy and “service”, the day that both Judge Cooijmans of the Rotterdam District Court and Bart Jan van Ettekoven of the Council of State spoke was a day to remember. Herr Cooijmans (the hero) who exposed how even accidentally entering the wrong date of birth or forgetting a zip code resulted in the stamp of fraud. Bart Jan van Ettekoven who said unemotionally and convincingly that the law simply did not offer the space to intervene. With what devastating consequences? Years' childcare allowance had to be reimbursed with a penalty of 100% on top of that. A hell of a hunt followed the parents. They lost their assets, their businesses, their relationships, their children, their health, their jobs, their family happiness. If you ended up in court, you were already detained in most courts. If you were lucky that a Court went along and ruled in your favor, the Council of State was ready to find you wrong after all. This did not start in 2013 with the Bulgarian fraud, no way back in 2005, right from the start of the surcharges.
Herr Cooijmans addressed this. Asked for a legs-on-table conversation. Nothing changed.
For me personally, I had this experience with the Central Netherlands Court before. This court stated that you can assume that the government is always right and reliable. In lawsuits that I had to conduct as an entrepreneur at the time, I managed to name SAOZ, which set the damage caused by government actions in my case at 0 euro in consultation with the Municipality, but via the Council of State, as biased. First in the Netherlands. Government institutions, even the courts, are also in cahoots.
The fact that even the Council of State now appears to have cooperated for years and thus apparently has not understood all the legal principles (proportionality, fairness, fairness, taking into account all circumstances) is a great shame. The reflection reports are a plus. The fact that you can be completely ruined as a citizen and entrepreneur based on racism and discrimination is world news.
When I look at the role of the Council of State, described on the website www.raadvanstate.nl, I note that the Supreme Court has deliberately and unnecessarily pushed citizens and entrepreneurs into the ravine with their children, their families, their families, their social environment for years without looking back. This is punishable, a major violation of human rights and cannot be dismissed by referring to an interpretation of the law after 15 years and receiving praise after 18 years.
